Spartanburg Counselor Faces Charges for Failing to Report Student Sexual Assault

In a shocking revelation, a guidance counselor at Clifdale Middle School in Spartanburg, South Carolina, has been accused of not reporting an alleged student sexual assault case to law enforcement authorities. The Spartanburg County Sheriff’s Office has subsequently charged Joy Allen, 61, with Failure to Report Child Abuse/Neglect, a misdemeanor offense under the South Carolina state law.

Detailed Allegations

According to the course of events described by the authorities, the victim, a student at Clifdale Elementary School, had on two distinct occasions confided in Ms. Allen about being sexually assaulted by a peer. The alleged offenses came to the knowledge of Ms. Allen between August 2021 and February 2024, but were not duly reported to either the Department of Social Services (DSS) or the relevant law enforcement agencies, as obligated by law.

The matter only came to light when the student divulged the information to a School Resource Officer (SRO) at Daniel Morgan Applies Technology Center. The allegations were later confirmed by the Children’s Advocacy Center, where the student had been interviewed and examined. The student reiterated during the interview that Ms. Allen had been informed about the incidents but failed to take any action, stating that it was too late to rectify the situation.

Counselor’s Response

Upon being confronted with these charges, Ms. Allen did not resist arrest and voluntarily turned herself in to the Spartanburg County Detention Center. As of now, she continues to be in custody, waiting for a bond hearing.

School District Response

Taggart Houck, Public Information Officer for Spartanburg School District 3 released a brief statement, “Spartanburg School District Three has been notified that, on June 25th, one of our guidance counselors was charged by the Spartanburg County Sheriff’s Office with a misdemeanor pursuant to the SC state law regarding the mandatory reporting of child abuse and neglect. In accordance with District practice, that employee has been notified that placement on administrative leave effective at the start of the 2024-25 school year will be enacted if the matter is not resolved prior to that date. As this is a personnel issue, the District will not comment further at this time.”
