Fernandez-Cruz, a 24-year-old who was in the country illegally. After the encounter, it was reported that Fernandez-Cruz allegedly failed to yield the right of way and did not stop to provide any assistance to Baker, choosing instead to flee the scene.

In a shocking twist, reports have surfaced revealing that Fernandez-Cruz was already under the radar of Immigration and Customs Enforcement (ICE) at the time of the accident, having a deportation order in place since September 2018.
